Nintendo files lawsuit against U.S. firm over pirated game software

Nintendo Co said Thursday it has filed a lawsuit against a U.S. firm for selling devices that allow users to download and play pirated versions of the company’s game software. The lawsuit was filed Wednesday in the Western District of Washington against NXPGAME Inc after the company ignored repeated warnings from Nintendo to stop selling the so-called game copiers on its multiple websites.

The game copiers available on the websites allow users to download, play and distribute illegal copies of the video game software of Nintendo DS and DSi portable game consoles.

A company spokesman said the lawsuit filed by a U.S. subsidiary did not specify the exact amount of damages sought.

‘‘Using game copiers to play unauthorized downloaded games is illegal and it’s wrong,’’ Jodi Daugherty, senior director of antipiracy at Nintendo of America Inc, said in a statement.

Nintendo is also suing NXPGAME for using the company’s registered trademarks on one of its websites in violation of copyright.
